Please read the following terms carefully, as they govern your use of The Leasing Masters' services, hereafter referred to as the "Services."

By accessing our Services or accepting the terms herein, you agree to be legally bound by these Terms of Services and our Privacy Policy found at theleasingmasters.com/privacy, collectively referred to as the "Agreement." Capitalized terms not defined herein are outlined in our Privacy Policy. If you do not agree to these terms without limitation or qualification, refrain from accessing or using the Services. Continued use of the Services post any changes to the Agreement indicates your acceptance and agreement with the then-current Agreement. As we reserve the right to modify the Agreement without notice, please check regularly for updates.

Eligibility

Our Services are not intended for individuals under the age of sixteen (16) years. By accessing and using the Services, you represent and warrant that you are at least 16 years old, not restricted by us or any law enforcement agency, not our competitor intending to use the Services for competition, have the authority to enter into this Agreement without violating any existing agreements, and will not violate our rights or those of third parties, including intellectual property rights.

IF YOU ARE NOT AT LEAST 16 YEARS OLD, YOU ARE NOT AUTHORIZED TO ACCESS THE SERVICES AND SHOULD LEAVE THE SITE IMMEDIATELY.

Registration and Security

While limited access is available to Visitors, to gain full access to additional Services, such as training courses and content modification, you must register for an account (an "Account"). Visitors become "Subscribers" upon registration. Ensure the information provided during registration is accurate, and keep it up-to-date. We reserve the right to suspend or terminate your Account for any reason, including inaccurate information. Safeguard your Access Credentials, notify us of any unauthorized use, and take sole responsibility for activities under your Account.

User Content, License, and Warranties

User Content: Subscribers may share various content ("Subscriber Content"), and Visitors may engage with our chatterbot ("Visitor Content"). Together, they form "User Content." While we do not review all User Content, accurate information is crucial for effective Services.

License Grant: By providing User Content, you grant us a non-exclusive license for the purpose of providing Services and producing de-identified content or aggregated data. We will employ reasonable measures to protect User Content.

Assignment of Comments: Comments provided as part of User Content are our exclusive property, and you assign all rights associated with them.

User Content Warranty: By providing User Content, you represent that you have the right to contribute it, the content is true and accurate, and its provision does not violate any obligations or rights of third parties.

Limited License to The Leasing Masters Content

For the purposes outlined in the Agreement, we grant you a limited, personal, non-exclusive, non-assignable, non-transferable, and revocable license to access, use, and display certain content ("Company Content") authorized for you. Unauthorized use, copying, distribution, or modification of Company Content is prohibited without our express written permission.

We may update the available Company Content without notice.

Company Content Disclaimer

All content provided by The Leasing Masters® is offered "AS-IS." Your access and use of our Services are at your own risk. The content may contain inaccuracies, errors, or outdated information. We do not guarantee the accuracy, reliability, completeness, or timeliness of the content, Services, or any hosted applications, programs, or other provided materials. We do not monitor information exchanged between you and other Visitors, Subscribers, or third parties and are not responsible for such content.

Intellectual Property

The Services, including content, features, and functionality (information, software, text, displays, images, video, audio, and design) are owned by The Leasing Masters or our licensors and may be protected by United States and international intellectual property laws. This includes trademarks, service marks, and logos. Unauthorized use of the content may violate applicable laws.

Restrictions

No Illegal Use: Do not use the Services to violate this Agreement, any law, infringe on intellectual property rights, or engage in defamatory, obscene, threatening, abusive, or hateful behavior.

Information Security: Prohibited actions include attempting unauthorized access, probing, phishing, denial-of-service attacks, or any activities that compromise the security of the Services.

Specific Prohibited Uses: Users are prohibited from actions like creating an unreasonable load on the Services, competing with The Leasing Masters, interfering with the proper function of the Services, attempting reverse engineering, or engaging in unauthorized data collection.

Right to Monitor and Enforce

We reserve the right to monitor your use of the Services, take necessary actions if we believe this Agreement is breached, including removing User Content, terminating access, or taking legal action. We may disclose identity information to third parties claiming violation of their rights.

Release of Liability

Release from Dealings: We cannot confirm the identity or truthfulness of Visitors, Subscribers, or their content. Your access to the Services and actions related to User Content are voluntary and your responsibility. You release us from claims arising from disputes with other Visitors or Subscribers.

Not Responsible For Offensive Posts: We may act as a conduit for User Content but are not obligated to screen content. We reserve the right to investigate and remove offensive content or take action against violations.

Limitation of Liability and Disclaimer of Warranties

Use at Your Own Risk: Your use of the Services is at your own risk. The Services are provided "AS-IS," without warranties, including availability, accuracy, or uninterrupted use.

Disclaimer of Warranties: We disclaim all warranties, including those concerning the Services' availability, accuracy, or content. We are not liable for damages resulting from the conduct of other Users.

Limitation of Liability: In no event shall we, our agents, or affiliated entities be liable for direct, indirect, incidental, special, or consequential damages. Our total liability is limited to the greater of the amount paid to us in the past twelve months or fifty dollars.

Links to Other Websites

At times, we may provide links to third-party websites offering external services or content. As we have no control over these external websites or resources, you acknowledge that we are not responsible for their availability, content, services, or actions. We do not endorse or accept liability for any content, advertising, products, services, or materials on or available from such third-party websites.

Suspension, Termination, and Survival

You can terminate your account at any time by providing written notice. Termination does not affect your existing obligations. We reserve the right to terminate or suspend your access to the Services without notice for any reason, including violations of this Agreement. We are not responsible for any loss or damage resulting from such suspension or termination. In case of a breach, we may pursue legal remedies, including deleting User Content and terminating your account.

Indemnity

You agree to hold us and our agents, employees, representatives, directors, officers, successors, and assigns ("Indemnified Parties") harmless from any loss, cost, claims, liabilities, damages, disputes, and expenses, including attorney’s fees, arising from your violation of this Agreement, posting defamatory or false User Content, your use of the Services, or infringement of third-party rights. The Indemnified Parties reserve the right to assume the defense and control of any matter subject to indemnification.

Your Obligation Not to Transfer in Violation of Any Law – and Transfer to the United States

If you are located outside the United States, you are notified that your User Content will be transferred to servers in the United States, and you consent to this transfer. You agree not to make any transfer except as permitted by applicable law. We make no representation that the content is appropriate outside the United States, and access from jurisdictions where the Services are illegal is prohibited.

General Provisions

Sever-ability/Waiver: If any provision is determined to be invalid, it shall be reformed to the maximum extent permitted by law. No waiver of any provision shall be effective unless in writing. Actions inconsistent with this Agreement do not constitute a waiver.

Compliance with Laws: Visitors and Subscribers shall promptly comply with all applicable laws governing the Services.

No Third-Party Beneficiaries: This Agreement benefits only you, us, and our respective successors and assigns.

Relationship of the Parties: We act as independent contractors, and nothing creates an agency, joint venture, or partnership relationship.

Assignment: We reserve the right to assign this Agreement to a successor entity in certain events.

Section Headings: Headings are for convenience and do not affect the interpretation of this Agreement.

Governing Law: Disputes are governed by the laws of South Carolina. Legal actions will be brought exclusively in the appropriate court within the State of South Carolina.
